Filing Guidelines
As a common law court of record, does RTCACL have rules?
We have guidelines that are subject to change depending on the circumstances. We recognize the existence of the Texas Rules of Civil Procedure, various statutes and codes from UNITED STATES and its affiliates, evidence codes, and even the Texas Revised Code. We do not, however, recognize the applicability of such documents to us. However, we may be persuaded in individual cases that ideas contained in such documents are consistent with common law and useful to achieving a just outcome in individual cases.
Who may file claims in our Court?
A competent man or woman domiciled on the land mass of the Texas republic and having claims against other men and women so situated or who have allegedly committed acts causing harm to the Texas claimant.
Who is responsible for serving claims?
At this time, we require that any claimant provide proof of having served 3 verified Notices of his or her claims against the men and/or women the claimant alleges have harmed that claimant. We require that a man or woman other than claimant provide proof by affidavit or sworn declaration that each notice was served. In the event the respondents, or some of them, have defaulted, claimant is responsible for providing documentation by yet another man or woman verifying non-response.
Once a claim has been correctly filed by petition to our court (at rtcommonlawcourt@rtcacl.net), with attached copies of all notices, affidavits, and exhibits, and $250 filing fees paid to cover our expenses for service of the petition and summons, we will provide the claimant with a file stamped copy of the filing, also by email. Certified copies carry a cost of $25 each due to the need to use a commercial delivery service. Upon rendering judgment, we will provide the claimant and all respondents with a file-stamped copy via email attachment.
In these inflationary times, we reserve the right to require payments to be made according to the definition of a dollar set forth in the Coinage Act of 1792 and 1900 as being 24.8 grains of gold or 371.25 grains of silver.
